1. Overview
This Privacy Policy explains what data we collect and how we use it. We do not use your conversation content for advertising. We do not use your uploaded images, conversations, or generated characters to train AI models.
2. Data We Collect
A) Account Information
Email address
Name (as provided by you)
Authentication/session data (including Google sign-in where used)
18+ confirmation via checkbox (we do not collect date of birth)
B) Conversation Data
Text you type
Speech-to-text transcriptions of your voice input (we store the text transcription, not raw audio)
C) Uploaded Images and Custom Characters (Beni Studio)
If you use Beni Studio to create a custom character:
Uploaded images: We store the image you upload in order to generate and maintain your character (including future edits such as tier upgrades). Uploaded images are retained while your account is active and are deleted when your account is deleted in response to a valid deletion request.
Generated character assets: The character images, animation videos, and associated settings (voice, personality, language) generated for you are stored in your account so you can continue using your character. They are deleted when you delete the character or your account.
Character memory: Conversation history and long-term memory associated with a custom character are retained until you delete that character or your account. Deleting a character permanently deletes its conversation history and memory.
Custom characters are private to your account and are not visible to other users.
We do not use your uploaded images or generated characters to train AI models.
D) Camera and Microphone Access
If you grant permission, we may use camera and microphone inputs to support real-time features. We do not store raw video or raw audio. Inputs are processed in real time and then discarded.
E) Payments
Payments are processed by Stripe. We do not store full card details. Stripe may provide transaction identifiers and billing status so we can operate the service.
F) Device and Log Data
We collect technical data such as IP address, user-agent, access timestamps, and diagnostic/error logs (including via tools such as Sentry).
3. How We Anonymize Conversation Logs
We separate account identifiers from conversation logs: Email addresses are stored separately from conversation logs. Conversation logs are associated with an internal user identifier, not your email. We do not store IP addresses in the conversation log dataset.
4. How We Use Data
We use data to: provide and operate Beni AI and Beni Studio, including generating and maintaining your custom characters; authenticate users and maintain sessions; process payments, manage subscriptions, and administer credits; maintain security, prevent abuse, and troubleshoot issues; improve quality and reliability, including using anonymized conversation logs to evaluate and improve performance; comply with legal obligations.
5. Sharing and Service Providers
We share data with service providers as necessary to operate the service, including: Stripe (payments); AWS (hosting/infrastructure); Sentry (error logging); AI service providers (used to generate responses, characters, and voice features): LLM: OpenAI; Speech-to-Text: OpenAI Realtime API; Text-to-Speech and voice generation: ElevenLabs; Image-to-video character generation: MiniMax (Hailuo). We share only what is necessary for these purposes. For character generation, your uploaded image is transmitted to our video generation provider solely to produce your character assets. If we change providers, we will update this policy.
6. International Transfers
Because we operate globally, your data may be processed in the United States and other countries. Where required, we use appropriate safeguards, which may include standard contractual clauses.
7. Retention
Uploaded images and generated character assets: retained while your account is active (or until you delete the character), and deleted upon account deletion in response to a valid request. Conversation logs and character memory: retained until you delete the relevant character or your account, or until we revise retention practices. Payment-related records: retained as needed for accounting, audit, and legal compliance.
8. Your Rights and Requests
Depending on where you live, you may have rights to request access, correction, deletion, or restriction of processing. To make a request, email hello@thebeni.ai. We aim to process deletion requests within 30 days where feasible. We may retain limited information where required for legal compliance, security, or fraud prevention.
9. Cookies
We use essential cookies for login and site functionality. We may also use analytics tools to understand usage and improve the service. If we introduce analytics tools, we will update this policy to describe the types of analytics used and the data collected.
10. Children
Beni AI is not intended for users under 18. We do not knowingly collect personal data from children, and uploading images of minors is prohibited.
11. Changes
We may update this Privacy Policy. The Effective Date indicates the latest version.
